Definition of Terms

  • DJ: Refers to the individual or team providing the music services for the event.
  • Client: The individual or entity hiring the DJ for the event.
  • Event: The specific occasion for which DJ services are contracted.
  • Equipment: All sound and lighting equipment provided by the DJ for the performance.

General

Liability

  • The DJ will not be held liable for any damages or injuries arising from individuals not directly affiliated with the DJ.
  • The Client is responsible for indemnifying and holding the DJ harmless from any claims, damages, or liabilities arising from the event.

Client Responsibilities

  • The Client agrees to provide proper coverage from the elements to protect the DJ and their equipment.
  • The Client must ensure appropriate access to power for the DJ's performance, including power for the reception, unless previously agreed upon for the ceremony.
  • The Client is responsible for securing any necessary permits and ensuring that the venue allows DJ services.
  • The Client must inform the DJ of any venue restrictions regarding sound levels or equipment usage.

Equipment and Damages

  • In the case of damage to the DJ's equipment caused by someone other than the DJ crew, the Client is 100% liable for any and all damages.
  • If repairs cannot be completed before the DJ's next event, the Client must cover the cost of any rental equipment and the acquisition and return of such equipment.

Venue Fees

  • The Client is responsible for any fees imposed by the venue's terms and conditions for the DJ to perform. These costs will not be deducted from the total due for the DJ performance.

Event Rescheduling

  • The Client may reschedule the event up to two times within one year of the original date. If the new date exceeds one year, the contract will be void, necessitating a new contract and deposit.
  • If the event is rescheduled more than two times, a new deposit will be required, even if within the original one-year period.

Promotional Use of Media

  • The Client agrees to allow the DJ to use pictures and/or video images taken during the event for promotional purposes. Clients may opt out of this provision by providing written notice prior to the event.

Performance Expectations

  • The DJ will perform for the duration specified in the contract or until the client and/or venue decide to stop the performance, including setup and breakdown times.
  • Overtime may incur additional charges, which will be discussed in the contract.

Sound Level and Volume Control

  • The DJ will adhere to venue restrictions and local noise ordinances. The DJ reserves the right to adjust sound levels as necessary.

Force Majeure

  • The DJ shall not be liable for failure to perform due to unforeseen circumstances, such as natural disasters, illness, or other emergencies.

Termination of Service

  • The DJ reserves the right to terminate services without liability in the event of abusive behavior from clients or guests.
  • The DJ reserves the right to stop the performance if the majority of the guests leave the event before the scheduled end time. The DJ will assess the situation and determine whether continuing the performance is feasible and appropriate.
  • The DJ will cease the performance if the Client leaves the event venue prior to the scheduled end time, as the Client's presence is essential for the continuity of the event.
  • If a fight breaks out, the DJ will stop the performance until it is cleared by the venue, authorities, and client.

Alterations to Agreement

  • Any amendments or alterations to this agreement must be made in writing and signed by both parties.

Payment

Full Payment:

  • Full payment is due one week prior to the event.

Late Payment Fee:

  • If full payment is not received by the end of the event, a late payment fee of 25% of the total cost will be added to the outstanding balance.

Retainer Fees:

  • A non-refundable retainer fee of $500 is required to secure the booking date. For events that include both a reception and a photo booth, the retainer fee is $800.
  • If the Client decides to forgo a service for which a retainer has been paid (e.g., Photo Booth), the retainer will not be applied to other services.

Fundraiser Events:

  • For fundraiser events, a retainer fee of $200 is required for DJ services and an additional $200 for the photo booth service. Please note that the photo booth service for fundraiser events does not include a memory book.

Returned Check Fee:

  • A returned check fee of $40 will be added to the total balance in the event of a bounced check.

Cancelation

DJ Cancellation:

  • The DJ reserves the right to cancel this agreement at any time. If the DJ cancels within two months of the event, a suitable replacement DJ will be provided, and all payments made will be refunded.

Client Cancellation:

  • The Client may cancel this agreement up to two months before the event and receive a refund of any payments made, excluding the non-refundable retainer fee(s).
  • If the cancellation occurs within two months of the event, the Client agrees to pay 50% of the total cost, and no refunds will be provided.

Cancellation Notices:

  • Cancellation notices can be made via phone or email. NOTA DJ Services will send a confirmation email acknowledging the cancellation.

Weather Conditions:

  • In the event of adverse weather conditions, the DJ will assess the situation and communicate with the Client at least one day in advance to discuss the best course of action for the event.

Acts of God:

  • Neither party shall be liable for failure to perform its obligations under this agreement due to acts of God, interruption of electrical power or other utilities, equipment failure, or other causes beyond their control. Both parties agree to notify each other as soon as reasonably possible following the occurrence of such an event.

Force Majeure:

  • In addition to acts of God, this agreement covers other unforeseen circumstances that may prevent either party from fulfilling their obligations. Examples include natural disasters, civil disturbances, or other emergencies. In such cases, both parties will discuss and agree on appropriate actions.

Rescheduling Policy:

  • If the Client wishes to reschedule the event rather than cancel, they must notify the DJ at least two months prior to the original date. The new date must be within one year of the original date to maintain the existing contract.
